Audit Associates will help you to fix your problem. We are experts in Voluntary Correction Programs/Voluntary Fiduciary Correction Programs (VCP or VFCP). The VCP or VFCP is a voluntary enforcement program that allows plan officials to identify and fully correct certain transactions; such as prohibited purchases, improper loans, delinquent participant contributions, and improper plan expenses. The program includes specific transactions and their acceptable means of correction, eligibility requirements, and application procedures. If an eligible party documents the acceptable correction of a specified transaction, the Employee Benefits Security Administration (EBSA) will issue a no-action letter.
Anyone who may be liable for fiduciary violations under ERISA, including employee benefit plan sponsors, officials, and parties in interest, may voluntarily apply for relief from enforcement actions, provided they meet the criteria and follow the procedures outlined in the VCP/VFCP. Provided there is no evidence of potential criminal violations (as determined by EBSA), and they have not conducted an investigation which resulted in written notice, the application will be considered. If, however, oral or written notification by EBSA has been received, the plan will be under investigation. Now, a mere complaint will not bring about an investigation, unless the complaint concerns the transaction described in the application.
